Don’t put your business and yourself at risk! Following the launch of “Flag It Up,” estate agents can expect further scrutiny from HMRC when it comes to anti-money laundering (AML) in 2019.

  • The 5th Money Laundering Directive will make Money Laundering compliance mandatory in elements of lettings as well as sales.
  • HMRC have recently introduced a series of fixed administration fees that will be payable on top of any fines issued.
  • The estate agency sector accounted for only 0.2% of suspicious activity reports (SARS) made in the last 18 months.
  • Risk assessments for businesses and as part of customer due diligence on both sellers and buyers are mandatory requirements as are PEPS and sanctions checks.
  • It is also now a requirement for key personnel in an estate agency business to be approved by HMRC, and staff are trained. undering Directive.

  • Consumer Protection Regulations 2008

These apply to both sales and lettings. They are wide reaching and challenging to comply with.

  • The industry is currently paying out £millions in “compensation” for easily avoidable breaches.
  • Ombudsman schemes require compliance with CPRs as part of their membership criteria
  • National Trading Standards have recently had their funding doubled by Government specifically to better police the estate agency sector.
  • Compliance with the CPRs will actually help you improve your listings, produce better quality viewings and and reduce fall throughs
